If your request for out of country prior approval is denied by the ministry, you may wish to have a hearing before the Health Services Appeal and Review Board. The procedure of the Appeal Board requires that you (the patient) mail or deliver a written request for a hearing to the Health Services Appeal and Review Board office within 15 days of receiving your denial letter :

The Health Services Appeal and Review Board (HSARB) is established by the Ministry of Health Appeal and Review Boards Act, 1998 to conduct appeals and reviews under fourteen different statutes. The proceedings under each of the statutes range from oral appeals to written reviews. The decisions being appealed to or reviewed by the Board include provision for service :

• decisions of the Ontario Health Insurance Plan respecting eligibility and payment;
• decisions of agencies under the Long Term Care Act respecting eligibility for service;
• orders of the Medical Officer of Health or public health inspectors;
• decisions of the Director with respect to licensing under the Nursing Homes Act;
• determinations of the placement co-ordinator respecting eligibility for admission to an approved charitable home for the aged; and,
• decisions of the Director with respect to licensing of independent health facilities.
