Health Protection and Promotion Act : Section 22.1 ("Bill 105")
Section 22.1 of the Health Protection and Promotion Act (HPPA) has been repealed. There is a new mandatory blood sampling process in place under the Ministry of Community Safety and Correctional Services (MCSCS) legislation : the Mandatory Blood Testing Act, 2006 (MBTA). The MBTA was proclaimed into force on August 10, 2007. If you are making an application after August 10, 2007, information can be obtained online from Ministry of Community Safety and Correctional Services (MCSCS) at www.ontario.ca/bloodtesting. For information on how applications made under the HPPA prior to August 10, 2007 will be handled, refer to the following Qs and As.
Section 22.1 (formerly "Bill 105") of the Health Protection and Promotion Act (HPPA) requires the taking of blood samples to protect victims of crime, emergency service workers, good Samaritans and other persons. Bill 105 received Royal Assent on December 14, 2001 and came into force on September 1, 2003 along with the regulation to support section 22.1 (Ontario Regulation 166/03 – Orders under section 22.1 of the Act). |
